En F.D Senator vid namn Ruangkrai Leekitwattana lämnade igår in en anmälan om upplösning av det Demokratiska partiet och banning av deras politiker p.g.a för att ha fått regeringsmakten 2008 på ett sätt som bröt mot landets konstitution.
Enligt Ruangkrai blev Abhisit PM 2008 trots att han tekniskt sett inte stöddes av minst 50% av ledamöterna, bland dom 219 Mp,s som röstade för Abhisit fanns 46 MP ifrån tre olika partier som hade blivit upplösta och dessa var inte medlemmar i något parti, vilket innebär att Abhisit och det Demokratiska partiet kom till makten utan stöd ifrån minst 50% av ledamöterna vilket alltså är ett brott mot konstitutionen.
Hans anmälan är en följd av att konstitutions Domstolen förra veckan tog ett beslut om att tillåta juridiska framställningar av motståndare till konstitutionella förändringar mot regeringen och koallitions partiern, så han gjorde denna anmälan direkt till Konstitutions Domstolen som verkar vara deras nya praxis istället för till "the Attorney-General's Office" som var brukligt fram tills förra veckan då Konstitutions Domstolen ansåg att detta inte är nödvändigt längre och att dom kan agera direkt utan att "the Attorney-General's Office" är inblandat.
Han har redan gjort denna anmälan en gång tidigare 2009 men då till "the Attorney-General's Office" som var brukligt fram tills förra veckan, men inga reaktioner på hans anmälan har kommit, så han utnyttjar nu konstitutions Domstolens nyligen ändrade rutiner och gör anmälan direkt till domstolen för ett avgörande.
Denne Ruangkrai är för övrigt samme man som anmälde Samak för matlagning i TV.
Det blir ett delikat problem för denna domstol som kanske inte hade väntat sig det här när dom ändrade sina rutiner förra veckan i syfte att hindra Parlamentet att fatta beslut, nu får dom smaka sin egen medicin.
Senator seeks Democrats' dissolution

Former senator Ruangkrai Leekitwattana yesterday petitioned the Constitution Court seeking dissolution of the Democrat Party and a political ban on its executives for allegedly gaining power to govern unconstitutionally.
Ruangkrai said that in December 2008, Democrat leader Abhisit Vejjajiva became prime minister despite being technically supported by less than half the MPs in the House of Representatives.
Among the 219 MPs who voted to back Abhisit as new prime minister, he said, 46 were from three political parties that had just been dissolved and were still not affiliated with any political party. Ruangkrai said that with those MPs excluded, it meant Abhisit and his Democrat Party rose to power with support from less than half the Lower House.
The ex-senator accused Abhisit and the Democrat Party of gaining power to govern unconstitutionally.
Ruangkrai's move came after the Constitution Court's decision last week to accept for judicial review petitions filed by opponents of constitutional amendment bills against the government and coalition parties. The court explained that Article 68 empowers individuals to file such a case directly with the court.
Ruangkrai said yesterday that he took the advantage of that decision by the court. He said he had filed his case in 2009 with the Attorney-General's Office but there had been no progress, so he decided to file the case directly with the court after last week's decision.
Although Abhisit's government no longer exists, he said there was still ground for the court to order the Democrat Party dissolved and its executives banned from politics.
In 2008, Ruangkrai's petition led to the Constitution Court verdict that then-prime minister Samak Sundaravej violated the charter for being hired to host a cooking television programme.
Article 267 of the Constitution prohibits members of the Cabinet from "being an employee of any person, or holding any position in a partnership, a company or an organisation carrying out business with a view to sharing profits or incomes".
