Thailand: Investigate Abuses Connected to Political Violence

Failure to Hold Government Forces Accountable Reinforces Impunity

May 2, 2011

(Bangkok) - No government official has been charged with a crime related to the political violence that wracked Thailand in April and May 2010, Human Rights Watch said in a new report released today. The government should undertake an impartial and transparent investigation and hold those among government security forces and protesters accountable for criminal offenses, Human Rights Watch said.

UDD detainees reported to Human Rights Watch that they had experienced torture and forcible interrogations, arbitrary arrest and detention, and overcrowded detention facilities.

Hej

Thailand: Serious Setbacks in Respecting Rights

25 Jan 2011 05:00

(New York) - The government of Prime Minister Abhisit Vejjajiva of Thailand failed to fulfill its pledges to hold human rights abusers accountable in 2010, a turbulent year for the country, Human Rights Watch said today in its World Report 2011. At least 90 people died and 2,000 were injured in street battles in Bangkok between March and May.

"Human rights in Thailand suffered a sharp and broad reverse in 2010," said Brad Adams, Asia director at Human Rights Watch. "Violence on the streets of Bangkok is the most troubling image of the past year, but just as worrisome was the willingness of a government that claims to be rights-respecting to ill-treat detainees and engage in broad-based censorship."

"Using the Emergency Decree on Public Administration in Emergency Situation, the CRES questioned, arrested, and detained UDD leaders and protesters, as well as accused sympathizers. The CRES also summoned hundreds of politicians, former officials, businessmen, activists, academics, and radio operators for interrogation; froze individual and corporate bank accounts; and detained some people in military-controlled facilities. The CRES also used emergency powers to hold some suspects without charge for extended periods in unofficial detention facilities, where there are inadequate safeguards against possible abuse in custody."

"The National Human Rights Commission reported that many UDD detainees had experienced torture and forcible interrogations, arbitrary arrest and detention, and overcrowded detention facilities. While the lifting of the state of emergency on December 22 was a positive development, the government has yet to provide the exact number and whereabouts of those detained without charge by the CRES, Human Rights Watch said."

Torture Report on Ratchaprasong Protesters

**This report has been written by the Social Movement Assembly and sent to me by Mr. Chaiwat Trakanratsanti. Chaiwat told me that Mr. Krissana was questioned by his lawyer during a visit. Chaiwat told me that only relatives with the same last name are allowed to visit them and only on Monday. Krissana’s good friend once tried to visit him and have Krissana’s parents sign a consent form but still his friend wasn’t allowed to see Krissana.**

"After they had knelt down for a while, one soldier came in and questioned them. The soldier asked “Do you know anything about the Red Shirt demonstration” , “Who is the core Red Shirt guards?”, “Where have the weapons been hidden? ” and he also asked which guards were shooting at soldiers. While they were questioned a group of soldiers were pointing guns to their heads the whole time and were also threatening them that there would be other soldiers coming to question them if they didn’t disclose this information.

Krissana told the soldiers that he didn’t have such information; he was just an ordinary citizen who joined and supported the Red Shirt demonstration.

There was another soldier with a black mask on who came in the room a few second after Krissana said that. The soldier was threatening them by saying if they didn’t tell the truth, he would choke them. But the three of them still insisted they didn’t have such information. Krissana stated that after answering, the soldier with the black mask on started to choke each of them for 30 seconds. Krissana also added that the solider used two fingers to choke him and he had struggled to stay conscious. His two friends were also choked, kicked and their backs were walked on. It was 45 minutes in total that they were questioned and tortured to give out information about the demonstration, and the soldiers also video recorded everything during the interrogation.

Another soldier then appeared whom the other soldiers saluted as he walked in. Mr. Krissana assumed this soldier was a higher-ranking officer. The “higher-ranking” officer then soaked the bodies and faces of the three men in lighter fluid. After he finished, he stepped back from them, about one metre away, and then lit a lighter. After that the soldiers put fireworks on the back of their shirts and threatened to burn them alive if they didn’t give out the information.

During the interrogation, the soldiers also whipped them and it was really painful for them."

The majority of who got killed was innocent people not drug traffickers.

In 2003 Thaksin gave the green light to the police and other authorities to show no mercy in cracking down on the narcotics trade in the country, in particular the networks supplying methamphetamines. In its letter, Human Rights Watch recalled lines Thaksin had delivered to justify the blood-bath. ‘’Because drug traders are ruthless to our children, so being ruthless back to them is not a bad thing,’’ Thaksin had said. ‘’It may be necessary to have casualties…If there are deaths among traders, it’s normal,’’

The consequences of those words became disturbingly clear early on in the anti-drug drive. During the first three months of that ‘war,’ which began in February that year, over 2,275 people were killed. Other deaths followed as the campaign was extended till the end of 2003.
