BUILDING CONSTRUCTION
Ownership
Unlike unimproved land, there are few restrictions on the ownership of buildings in
Thailand. Foreign companies and foreign individuals may own buildings, even though they
do not own the land on which the building is located. To construct or own a building in such circumstances, the foreign company or individual would need to lease the land, have
permission from the landowner to occupy the land, or otherwise have evidence of the
consent of the landowner to the foreigner’s building occupying the land.
Under provisions of the Civil and Commercial Code:
• A person who is threatened with injury from a building or other structure belonging
to another person is entitled to require the owner to take necessary measures to avert the danger.
• If damage results from defective construction or inadequate maintenance of a
building, the person in possession of the building is obligated to provide compensation.
However, if the person in possession has exercised appropriate care, the building owner is
obligated to pay compensation.
• The occupier of a building is responsible for the damage arising from things which
fall or are thrown from it.
Building Codes
The construction of new buildings and modification of existing buildings are regulated
primarily by the Building Control Act and regulations issued under the Act. The Building
Control Act was originally issued in 1979 and had significant updates in 1992 and 2000.
The Act gives the authority to issue and enforce regulations for building construction to
the Ministry of Interior and to authorized local provincial and municipal bodies. These
entities are empowered to regulate the size, location, load capacity, systems for electricity,
water, and gas, ventilation, drainage, wastewater, construction methods, and other aspects
of building construction.
Before beginning construction or alteration of any building, the building owner must
submit building plans and obtain a building permit from the local authority. For most
buildings, the construction must be supervised by a licensed engineer who has given written
consent to act as supervisor. The building as constructed must conform to the approved
plans. The local competent authority is empowered to order the removal or demolition of
construction not conforming to regulations or the approved building plans, as well as
impose fines or prison terms for violation of building permit regulations.
