The Military Court has for the first time in history suspended the jail term for a pro-establishment yellow shirt lese majeste convict, accused of publishing a false royal statement.

The Military Court of Bangkok on Tuesday, 29 September 2015, sentenced Niran Yaowapa, a former editor of ASTV Manager Online, a yellow shirt news outlet, to five-years imprisonment under Article 112 of the Criminal Crime Code, lese majeste law, and Article 14 of the 2007 Computer Crime Act for importing illegal computer contents.

Niran was convicted under the lese majeste law for publishing a forged statement of the Bureau of the Royal Household, which stated that King Bhumibol had decided to appoint a Regent to act on his behalf on 2 February 2015. The case caused ASTV to demote Niran from his post.

Since the defendant pleaded guilty, however, the court halved the jail term to two-years and six-months. The military court also suspended the jail term for two years, reasoning that the convict tried to fix his mistake by immediately taken down the false statement from ASTV website as soon as it had been notified and issued a statement of apology.

The military court on 10 February 2015 approved custody warrants for Niran and Krit B., another lese majeste suspect accused under the same case, who is an active member of the United Front for Democracy against Dictatorship (UDD), the main faction of the anti-establishment red shirts.

While the military court granted 2.9 million baht bail to Niran on the same day when the custody warrant for him was issued, citing that there was no flight risk, Krit was held under custody for two weeks.

Krit and his defense lawyer, Winyat Chatmontree from Free Thai Legal Aid, submitted 400,000 baht bail request, but the court denied bail, citing flight risk and severity of the case.

After the court’s decision not to grant bail to the red shirt suspect, but to the yellow shirt suspect charged under the same offenses was highly criticised as biased, the military court granted 400,000 baht bail to Krit on 17 February 2015.

The red shirt was arrested by more than ten military and police officers at his house in central Phetchabun Province on 3 February 2015. The officers interrogated him at a nearby police station for around three hours before searching the houses of two of his friends. Krit was then detained at a military camp for seven days before being detained at the Bangkok Central Remand Prison for another seven days.

The lese majeste case against Krit B. is still ongoing and the next trial on the case will be held on 19 October 2015.

In politics, in recent years, the lese majeste law has been used to target political opponents of the royalist regime, and most especially red shirts.

The political interventions by the monarchy and on its behalf have been eye-opening for some. For others, these interventions have been a part of a restorationist project since 1932.

Leaving aside the vicious attacks on the prince’s problems and the use of lese majeste to “solve” those marriage issues, when red shirts have been accused of lese majeste, the outcome has been jail for almost all, sometime for decades. The military courts under the military dictatorship has been especially vicious.

But not for those who are identified as supporters of the military regime and yellow-shirted politics.

Du som säger dig vara emot LM måste väl vara glad när straffen för detta blir lägre?

Double standards är inget som du kan kritisa någon för, hur extrem den än månne vara bleknar den mot dina double standards.

Hej

På ett sätt ja, men när det som det sägs i artikel handlar om uppenbar double standard och enbart sänkta straff för gulskjortor så känner man snarast avsky och ökat misstroende för den s.k rättvisan i Thailand.

Politisk färg ska ju inte vara avgörande för nivån på borgensumman och om man får sitt straff sänkt eller ej, en domstol värd namnet ska ju behandla både röda och gula likadant vid samma typ av brott.

Själv ser jag precis som skribenten detta som ett tydligt tecken på double standard och hur kuppmakarna styr domstolarna till att positivt särbehandla gula brottslingar.

Du har fortfarande inte lyckats redovisa vari denna double standard består. Enligt artikeln förklaras gulskjortans nedsatta straff etc. av hans beteende -  något som inte redovisas i rödskjortans fall. Så vari består skillnaden annat än den ene kom undan med betydligt lägre borgenssumma?

Som det nämndes i artikeln så var det första gången i landets historia som en militärdomstol sänkte straffet för en LM brottsling och det var säkerligen ingen tillfällighet att han råkade vara en känd gulskjorta, sen är det ju anmärkningsvärt att nivån på borgensummorna är så olika för röda och gula för samma brott.
