Enligt Human Right Watch har en 57-årig kvinna vid namn Theerawan Charoensuk greps för att ha publicerat en bild på Facebook där hon håller en röd plastskål med inskrivna Thai nyårshälsningar från tidigare premiärministrarna Thaksin Shinawatra och Yingluck Shinawatra.

En militärdomstol Chiang Mai släppte henne senare mot borgen på 100.000 baht (US $ 2800) i väntan på en militär rättegång. Om hon befinns skyldiga, kan Teerawan få upp till sju års fängelse.

HRW kräver nu att (NCPO) juntan omedelbart upphör med sitt missbruk av lagen och sin drakoniska uppvigling mot fredliga kritiker och oliktänkande.

Woman Faces Military Trial, 7 Years in Jail for Facebook Posting

(New York) – Sedition charges for a Facebook photo expressing symbolic support for Thailand’s political opposition shows the military junta’s utter disregard for peaceful dissent, Human Rights Watch said today. The National Council for Peace and Order (NCPO) junta should immediately end its abusive use of the draconian sedition law against peaceful critics and dissenters.

On March 29, 2016, authorities arrested 57-year-old Theerawan Charoensuk for posting her photo holding a red plastic bowl inscribed with Thai New Year greetings from former Prime Ministers Thaksin Shinawatra and Yingluck Shonawatra. Chiang Mai military court released her on 100,000 baht (US$ 2800) bail pending a military trial. If found guilty, Theerawan could face up to seven years in prison.

 

“The Thai junta’s fears of a red plastic bowl show its intolerance of dissent has reached the point of absolute absurdity,” said Brad Adams, Asia director. “When military courts try people for sedition for posting photos with holiday gifts from deposed leaders, it’s clear that the end of repression is nowhere in sight."

 

Deputy Prime Minister Gen. Prawit Wongsuwan defended the charges in a media interview on March 29: “The charge [against Theerawan] is not arbitrary or groundless. She violated the law. Tell me if you think what she did was not provocative or led to division in the society. We don’t want to arrest anyone. But those people should listen to our warning not to undertake political activities.”

 

The junta considers any peaceful expression of dissenting opinions to be a threat to national security. The military authority also prosecutes those it accuses of being involved in anti-junta activities or supporting the deposed government.

Sedition is defined under article 116 of Thailand’s Criminal Code as:

Whoever makes apparent to the public by words, writing or any other means anything which is not an act within the purpose of the constitution or which is not the expression of an honest opinion or criticism (a) in order to bring about a change in the laws or the government by the use of coercion or violence, (b) in order to raise confusion or disaffection amongst the people to the point of causing unrest in the kingdom, or (c) have people violate the law, shall be punished with imprisonment not exceeding seven years.

Since the military coup in May 2014, at least 38 people have been charged with sedition – including former Education Minister Chaturon Chaisaeng for a speech at the Foreign Correspondents Club of Thailand criticizing military rule (May 2014); Sombat Boongamanong, an activist, for Facebook and Twitter posts calling people to join anti-junta rallies (June 2014); Pansak Srithep, an activist, for saying the military should be held accountable for the 2010 political violence and calling for an end to military trials of civilians (March 2015); and 14 activists from the New Democracy Movement (NDM) for staging a rally demanding a transition to democratic civilian rule (June 2015).

NCPO chairman and Prime Minister Gen. Prayut Chan-ocha said at a January 21 news conference that the authorities had wide leeway to arrest anyone deemed to be opposed to military rule:

Why don’t people respect the laws instead of asking for democracy and human rights all the time?… No one is allowed to oppose [the NCPO]. I dare you to try to oppose [the NCPO].... I don’t care what the international community would think about this. I will send officials to explain to foreign embassies. I am not afraid of them. I will tell them to understand that this is Thailand and we are enforcing Thai laws.

“Thailand’s friends and neighbors should make clear that with each ludicrous new arrest, the junta’s global standing drops lower and lower,” Adams said. “They should press the junta to end its persecution of peaceful dissent and fulfill its frequent promises to restore democratic rule.”

Ja vad ska man säga, taket blir minst sagt lägre och lägre för var dag, hamnar man i en militärdomstol för att ha visat sig på bild med en röd skål går väl snart ingen längre säker i Thailand, militären verkar ha drabbats av hybris.

Turerna om den röda skålen går vidare, militären gillade tydligen inte den uppmärksamhet artikeln väckte och Thairath nyheter rapporterade på Onsdag 30 mars 01:30 att polisen i Chiang Mai på kontaktade  Thairaths redaktionen i provinsen och beordrade dem att skicka Chefen för Thairaths nyheter Chaipat Kattiya, och en annan Thairath anställd till Kawila militärbas för en diskussion.

Gen Koson Prathumchat frågade sedan ut dom båda om vem som tog bilden av den röda skålen, dom svarade att det inte togs av en journalist, men av god vän.

Generalen berättade för dom båda en sådan bild och nyhetsartikel kan väcka konflikter och instabilitet, och tillade att de inte bör rapportera om sådana nyheter igen.

Efter att ha förhörts av militären skickades dom två till polisen för ytterligare en runda av utredning och fick sen gå hem utan vidare åtgärder.

Även om inget straff blev påföljden så visar det ändå hur lågt det är till tak i juntans Thailand när journalister och chefer på tidningar uppmanas att sluta rapportera om militära ingripanden i löjliga fall som det här med skälet att det kan skapa konflikter och instabilitet.

Thai military summoned journalists in the northern province of Chiang Mai for a discussion over reporting news about a red bowl inscribed with Thai new year greetings from former Prime Ministers Thaksin Shinawatra.

Thairath news on Wednesday, 30 March 2016, reported that police officers in Chiang Mai at 1:30 pm contacted an editorial team of Thairath in the province and ordered them to send Chaipat Kattiya, head of local Thairath news crew, and another Thairath personnel into Kawila Military Base for a discussion.

At the military base, Mai Gen Koson Prathumchat, commander of the Internal Security Operations Command (ISOC) of the 33rd Army Division, asked the two journalists about a news article about the red bowl, which was published on Thairath news website 26 March.

The news article shows a picture of the red bowl, which is inscribed with a message reads “Although the situation is very heated, may all brothers and sisters receive cool bliss from this bowl with love and care. Happy Songkran Day” and Thaksin’s signature.      

Asked by the military General where they got the picture of the red bowl from, the two informed the officers that it was from a viral social media campaign to save water for the upcoming Songkran Festival.

They added that the main content of the news article with the red bowl picture was about such campaign.

The military officer then inquired the two further as to who took the picture of the red bowl in which one of them answered that it was not taken by a journalist, but by a friend.

The officers told the two that such picture and news article could incite conflict and instability, adding that they should not report on such news again.

After being interrogated by military officers, the two were sent to the police for another round of inquiry and were allowed to go home without charges.

On Tuesday, military officers in Chiang Mai arrested Theerawan Charoensuk, 57, for posting a picture of herself holding the red bowl with a Songkran message from Thaksin on facebook.

The picture of the bowl was posted on her facebook profile together with images of Thaksin and his sister, Yingluck Shinawatra, with a message reading “Happy 2016 Songkran Day, this Songkran, I especially miss all my brothers and sisters very much and want to help you solve problems, but before that I would like to send encouragement, love and thoughts.”

The military filed a charge against Theerawan under Article 116 of the Criminal Code, the sedition law, for posting such picture. However, yesterday, the Military Court of Chiang Mai released her on 100,000 baht, about 2800 USD, bail pending a military trail. If found guilty, she could face up to seven years in prison.
